Insurance Issues
Following industry lobbying, DEFRA have recently appointed a civil servant to work on insurance issues surrounding the former Mirvahedy judgement. They are keen to look at opportunities to amend the law to add a clause of “reasonable care” whereby if owners of escaped livestock which have caused damage can prove that they have taken all reasonable steps to secure their animals they will then not be seen as liable. We are currently looking at opportunities to amend legislation under the Compensation Bill currently on its way from the Lords to the Commons.
